This data protection information on the application process explains how we process your data when you apply for a position with us.

The following data protection information provides details of how we handle your data, your rights in connection with this and how you can exercise these rights.

Data Protection Information regarding the Application Process

Arthrex LTD takes the protection of your personal data very seriously. Any transmission of your data is subject to an SSL encryption.

We process the personal data relating to your person which you provide as part of the application process or which we collect or create in this context (hereinafter collectively referred to as "applicant data") for the duration and for the execution of the application process (legal basis: Performance of pre-contractual measures as per point b) of Art. 6(1) GDPR). You must create a user account in our online job portal to apply. In addition to applying for specific jobs, our online job portal allows you to create a profile, make this visible to our recruiters at home and abroad and be notified of vacancies. Your registration data (the nature of this data and whether this information is mandatory or voluntary is evident from the input screen) and profile and all other information which you provide will be stored for an unlimited period of time in order to fulfill the existing user contract with you until you delete the user account or we terminate the user account (legal basis: point b) of Art. 6(1) GDPR). Upon registration, the IP address assigned to you by your Internet Service Provider (ISP) as well as the date and time of registration will be saved. The data is stored to protect our legitimate interest, to prevent abuse of our services and, if necessary, to prosecute such abuse (legal basis: point f) of Art. 6(1) GDPR).

You can delete your user account at any time. After deletion of the user account or our termination, we will retain all data for up to six months. This serves to safeguard our legitimate interest in being able to restore this data in the event of unintentional deletion or in the assertion, exercise or defense of legal claims in connection with the contract of use (legal basis: point f) of Art. 6(1) GDPR).

Depending on the vacancy for which you have applied, your personal data may be shared with other Arthrex companies. You can find more detailed information in our Privacy Statement.

On completion of the application procedure, we will continue to store your data for a limited period. We generally do not keep personal data records for more than six months following completion of the selection procedure provided that no other legal obligations exist. Processing of Applicant Data

In this section, we let you know how we handle personal data concerning you, which we collect in connection with applications for a position at our company or the group of undertakings, and what rights you have in this respect.

Data Collection, Legal Basis and Processing Purposes (Including the Legitimate Interests We Are Pursuing)

To ensure effective protection against unauthorized access, we ask you to send us your application documents exclusively via the secure connection provided for this purpose in our online job portal.

If you register with us as an applicant and send us application documents, we will store and process your contact information, your application documents (in printed or electronic form) and all documents and records concerning you made as part of the application process (all of this data and these documents are hereinafter referred to jointly as "applicant data") for the duration and implementation of the application process (legal basis: point b) of Art. 6(1) GDPR).

In general, we do not need any special categories of personal data for the application process. We ask that you do not send us any such information at all. If such information is relevant for the application process in exceptional cases, we will process it along with your other applicant data. This may include information regarding prohibited activities due to pregnancy or health restrictions, or information regarding severe disability to satisfy our special duties regarding severely disabled individuals. In these cases, the purpose of processing is to exercise rights or to satisfy legal obligations under employment law, the right to social security and social protection (legal basis: point b) of Art. 9(2) GDPR) in connection with Section 26 Federal Data Protection Act) or to evaluate your capacity for work (legal basis: point h) of Art. 9(2) GDPR) in connection with Section 22 Para. 1 b) Federal Data Protection Act).

We store and process personal data of applicants to carry out screening and comparisons for transparency purposes in order to prevent corruption, money laundering, financing of terrorism, for export inspections and to carry out other compliance checks required by law or provided for in our corporate guidelines. This is done to fulfill legal requirements (legal basis: point c) of Art. 6(1) GDPR) as well as, where our corporate guidelines go beyond statutory requirements, to safeguard our legitimate interest to avoid business relationships that do not meet our ethical standards (legal basis: point f) of Art. 6(1) GDPR).

If you send us documents or information as part of the application process that is not necessary for the application process, we will process it to the extent that your consent applies (legal basis: point a) of Art. 6(1) GDPR).

Recipients and Categories of Recipients

If you have stated in our online job portal that your profile and other applicant data can also be made available to recruiters in other countries or even worldwide, they will be able to view your data. This information will then be accessed and processed by the respective company from the group of undertakings on its own responsibility and not on our behalf. The legal basis for transmission is fulfillment of the existing contract of use with you (legal basis: point b) of Art. 6(1) GDPR).

If the position advertised is based at another company in our group of undertakings or is related to another company, e.g., the position reports to an employee of another company in the group of undertakings (as part of a matrix structure), we might also make the applicant data accessible to those employees of other companies in the group of undertakings that we will involve in the selection process. This serves the purpose specified under Clause 9.2 and to safeguard our legitimate interest in the exchange of information within the group of undertakings as required to carry out the application process (legal basis: point f) of Art. 6(1) GDPR).

Transmissions to Unsecure Third Countries and Guarantees regarding such Transmissions

Normally, the recipient of applicant data in accordance with Clause 9.3 will not be located in an unsecure third country. If this is the case by way of exception however, we will arrange suitable guarantees for screening procedures with the recipient to ensure a suitable level of data protection.

If you have stated in our online job portal that your profile and other applicant data can also be made available to recruiters in other countries or even worldwide, they will be able to view your data. This information will then be accessed and processed by the respective company from the group of undertakings on its own responsibility and not on our behalf. Should such companies be located in an unsecure third country, the legal basis for transmission there is your express request for transmission (legal basis: point b) of Art. 49(1) GDPR).

Storage Duration and Erasure

If the application procedure is successful, the applicant data will be stored and used as part of your HR files in order to fulfill the employment contract entered into with you.

If the application process is not successful, we will store copies of your applicant data for a further six months after the end of the application process, and then will erase or anonymize it. The purpose of the storage of this data and these documents is to safeguard our legitimate interest in the assertion, exercise and defense of legal claims in connection with the application process, especially in the event that we need it as evidence in the defense against claims of discrimination in the selection process (legal basis: point f) of Art. 6(1) GDPR).
